In years gone by, there was a preference by the Courts to award custody of 

children, especially young ones, to the Mother. Times changed and so have the Courts. 

The guiding principle in any custody action is the “best interests of the child”. This 

involves a detailed analysis of everything that impacts the child’s well-being and 

welfare. There is no longer a preference for one parent or the other in the eyes of the 

Court and either parent comes to Court with an equal chance of being a major part of a 

child’s life whether that be through primary, partial or shared custody.
